Terms of Use
1. Who These Terms Cover
These Terms of Use are an agreement between you and ProfWorkBench, LLC, a New York limited liability company ("ProfWorkBench," "we," "us," or "our"). They apply to our applications (the "Software"), our websites, our secure contact desk and our programs (together with the Software, the "Services"). By downloading, installing or using the Services, you agree to these Terms. If you use the Services for an organization, you agree on its behalf and confirm that you are authorized to do so. If you do not agree, do not use the Services. You must be at least 13 years old to use the Services; if you are under the age of majority where you live, you may use them only with the permission of a parent or guardian.
2. Primary Controlling Agreement
For applications obtained from Apple's App Store, these Terms act as a supplementary agreement. The primary, controlling agreement governing your use of those applications is the Apple Standard End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict, the terms of the Standard EULA shall strictly govern. All terms below exist solely as additional protections and caveats specific to the unique nature of ProfWorkBench software.
Overwrite Elite is not distributed through the App Store, and the Standard EULA does not apply to it. These Terms, including section 8, are the licence agreement for Overwrite Elite, and they govern our websites, desk and programs.
3. Lawful and Authorized Use
Many of our applications examine evidence, networks, devices and communications. You may use them only on data, devices, networks, accounts and communications that you own or are authorized to examine, and only in compliance with the laws that apply to you, including laws on computer misuse, interception of communications, recording, privacy and data protection. You are solely responsible for obtaining any consent, warrant, authorization or legal advice your use requires. We may refuse or end access to the Services for anyone who uses them unlawfully or to harm others.
4. Disclaimer of Warranties ("As Is" Basis)
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE SOFTWARE AND THE OTHER SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT CONTINUOUS SUPPORT, WARRANTIES, OR REPRESENTATIONS OF ANY KIND. LIKE ALL SOFTWARE, AND GIVEN THE COMPLEXITY OF DIGITAL FORENSICS, NETWORK PROTOCOLS, AND DATA SANITIZATION, THE SOFTWARE MAY CONTAIN ERRORS AND MAY CRASH OR FAIL.
WE EXPLICITLY DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE, OR THAT THE RESULTS GENERATED (INCLUDING HASHES, LOGS, REPORTS, CERTIFICATES, OR PACKET CAPTURE ANALYSES) WILL BE ACCURATE, COMPLETE, ADMISSIBLE IN A COURT OF LAW, OR RELIABLE. THE SOFTWARE IS NOT A SUBSTITUTE FOR INDEPENDENT PROFESSIONAL FORENSIC VALIDATION.
Nothing in these Terms excludes or limits any warranty, guarantee or right that cannot be excluded or limited under the law that applies to you.
5. Results Are Yours to Verify
Hashes, logs, certificates, reports, timestamps and other outputs of the Software describe what the Software observed and recorded. They are not legal advice, they are not a finding by ProfWorkBench, and they do not guarantee that any record is authentic, complete or admissible. Any certificate or record the Software signs is signed by the Software on your device and proves only what its own text says it proves. Verify results independently before relying on them in any proceeding.
6. Application-Specific Terms
A. Overwrite (High-Risk Activities)
WARNING: OVERWRITE IS DESIGNED TO IRREVERSIBLY DESTROY DATA.
- Irreversible Action: When you use Overwrite to wipe a drive or partition, Overwrite is designed to overwrite the data so that ordinary means cannot recover it, and you should treat every wipe as irreversible. Flash media such as SSDs, SD cards and USB drives can keep data in cells that an overwrite cannot reach, so no overwrite can guarantee that every trace is gone; Overwrite's certificate states what was actually done. You acknowledge that we are not responsible for the recovery of any data, intentional or accidental, deleted by the Software.
- Hardware Wear: Executing multiple overwrite passes on SSDs, SD Cards, and USB Flash Drives can degrade the physical lifespan of the memory cells.
- User Responsibility: It is solely your responsibility to verify you have selected the correct drive before initiating a wipe.
B. MetaWrite & MetaLume
- Metadata Removal: MetaWrite and MetaLume save the result as a new copy and leave your original file unchanged. In a PDF changed by MetaWrite, earlier metadata values can remain inside the copy and be recovered with other tools. Keep your original files if you need the original metadata for preservation purposes.
- MetaLume: MetaLume never changes your original photo. It saves a separate copy without the removed metadata, and that metadata cannot be recovered from the copy. The copy is not a forensic duplicate: its file dates are set to noon UTC on the capture day, and JPEG and HEIC copies are re-encoded. Keep your original if you need it for preservation.
- Reports (MetaWrite Pro): MetaWrite's PDF report (the app's "Export Certificate (PDF)" button; the PDF is titled "Forensic Certificate") is informational. It is not signed, it does not prove when, where or by whom a file was made, and it does not constitute legal advice.
C. HeaderLume
- Third-Party APIs: The use of the VirusTotal, rdap.org and ipwho.is integrations is subject to their respective terms of service. You agree not to abuse these APIs.
- Results Are Leads: Results from the language scan and the lookup features are leads for your own analysis, not conclusions; confirm them before you rely on them.
D. HashLume
- No Warranty of Integrity: While we utilize standard hash and checksum algorithms, we do not guarantee the absolute security or mathematical infallibility of the generated checksums against all future vulnerabilities.
E. pcapLume
- Third-Party Enrichment: GeoJS lookups (with Pro, while Zero Telemetry is off), MalwareBazaar lookups (only with your own abuse.ch key), and any Shodan, Censys or threat-feed queries you start are subject to those services' terms and availability.
- Compliance and Consent: You may use pcapLume only on packet captures you are legally entitled to examine. You are strictly prohibited from using it to analyze traffic you captured, or caused to be captured, from networks or devices you were not authorized to monitor. Analyzing public sample captures, teaching and training material, and captures you obtained lawfully, such as through discovery or from a client who was entitled to provide them, is permitted. Section 3 applies to all such use.
F. QRLume
- Sandboxed Analysis: You acknowledge that while QRLume isolates payloads from executing, you assume total risk for any links or payloads you manually elect to export or execute outside QRLume.
G. DEV (Digital Evidence Vault)
- Hashing and the custody log: DEV records SHA-256, SHA-1 and MD5 hashes of each exhibit, computed on your device by Apple's CryptoKit, and a custody log in which each entry is hashed and linked to the one before it. This makes a later change to an exhibit or to the log detectable; it does not prevent one. DEV adds no encryption of its own. ProfWorkBench, LLC has no access to your data and cannot repair or restore an altered exhibit or custody log.
- Trusted timestamps: While the corresponding options are on (they are on by default), DEV sends the digest of each photo, video, audio recording or note captured in DEV, and of each file imported in DEV, to the RFC 3161 Time Stamping Authority at freetsa.org and to public OpenTimestamps calendars. Apple Watch recordings, files shared into DEV from other apps and evidence packages imported from another examiner are not timestamped by DEV. These are third-party services outside our control and are used subject to their own terms and availability. We do not guarantee that they respond, how soon an OpenTimestamps calendar commits a digest to the Bitcoin blockchain, or that they will continue to operate. DEV stores the receipts it obtains; it does not upgrade an OpenTimestamps proof to a Bitcoin attestation or verify a Time Stamping Authority's certificate chain.
- Lawful recording: You are responsible for complying with the recording, privacy and consent laws that apply to you whenever you use DEV's camera and microphone recording, its scene audio log or the Apple Watch's Discreet Launch. DEV does not check what your jurisdiction permits.
H. WADL Builder
- Self-reported labels: A Wandt AI Disclosure Label is the author's own account of how AI was used. WADL Builder records that account; it does not detect AI use and does not verify that a label is true. Nothing produced by the Software is a finding of academic misconduct or of its absence. Decisions about coursework remain the instructor's and the institution's.
7. Genesis Partner Scope
The "Genesis Partner License" is strictly marketing nomenclature signifying a standard Apple "Non-Consumable" lifetime software license tier, intended for buyers who want a permanent licence instead of a recurring subscription.
- No Corporate Equity: Purchasing this tier grants strictly zero equity, zero voting rights, and zero creative or operational control over ProfWorkBench, LLC or its subsidiaries.
- Per-Application Basis: A Genesis Partner License strictly unlocks ONLY the single, specific application through which it was purchased. It is explicitly NOT a bundle, subscription, or global master key to the broader ProfWorkBench software catalog.
- Lifecycle Definition: The term "Lifetime" refers exclusively to the supported operative lifespan of the specific application executing the purchase, not the biological life of the purchaser.
- Risk Adherence: All software obtained under the Genesis Partner License tier remains bound to the strict "As-Is" disclaimers regarding forensic integrity, volatility, and data accuracy outlined in section 4.
8. Overwrite Elite Licence
- Licence grant: When you buy an Overwrite Elite licence, we grant you a limited, non-exclusive, non-transferable licence to install and use Overwrite Elite within the scope of the licence you purchased (for example, one user on two Macs for Elite, five users for a Lab Pack, or one location for a Site License), for as long as you comply with these Terms.
- Activation: Overwrite Elite activates and periodically re-checks your licence through Lemon Squeezy. You may not share, resell or publish licence keys, or circumvent activation or any technical limit of the licence.
- Purchases and refunds: Overwrite Elite is sold through Lemon Squeezy, which processes payment as the seller under the terms shown at checkout. Refunds are handled under those terms. We may deactivate a licence that was refunded, charged back or obtained fraudulently.
- Restrictions: Except as the law expressly permits despite this restriction, you may not copy, modify, decompile, reverse engineer or create derivative works of Overwrite Elite, or rent, lend or sublicense it.
9. Subscriptions and Payments
Payments, subscriptions, and renewals for the App Store applications are handled by Apple Inc. via the App Store, under Apple's terms; subscriptions renew automatically until you cancel them in your Apple account settings, and refunds for them must be submitted directly to Apple Customer Support. Overwrite Elite licences are sold through Lemon Squeezy under its checkout terms (section 8).
10. Third-Party Services
Some features use services operated by others, such as Apple's iCloud, Maps, speech and App Store services, Lemon Squeezy, Cloudflare, Discord, and the lookup and timestamping services named in our Privacy Policy. Those services are provided by their operators under their own terms. We do not control them and are not responsible for their availability, accuracy, conduct or continued operation.
11. Pre-Release Software and Programs
Beta and other pre-release versions are provided for testing, may be incomplete or unstable, and should not be relied on for casework. Participation in our programs is subject to the program terms published on our programs page, and we may change or end a program, or a participant's access to it, at any time. If you send us feedback, suggestions or bug reports, you grant us the right to use them without restriction or payment.
12. Intellectual Property
The Software, our websites and their content, and the ProfWorkBench name, logos and product names are owned by ProfWorkBench, LLC or its licensors and are protected by law. Apart from the licences described in these Terms and the Standard EULA, no rights are granted to you, and you may not circumvent any purchase, licence or technical limit of the Software. Where we publish a component, standard or document under an open licence, that licence governs it.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROFWORKBENCH, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, CATASTROPHIC DATA LOSS, HARDWARE DEGRADATION, LOST PROFITS, EVIDENTIARY CORRUPTION, OR ANY LEGAL CONSEQUENCES ARISING OUT OF THE USE, INABILITY TO USE, OR MALFUNCTION OF THE SOFTWARE. YOU ASSUME TOTAL RESPONSIBILITY AND ALL RISK ASSOCIATED WITH USING THE SOFTWARE.
Our total liability for direct damages from any claim arising out of or relating to the Services is limited to the greater of the amount you paid for the Software giving rise to the claim or fifty U.S. dollars (US$50). For App Store applications, the limitation in the Standard EULA applies. Nothing in these Terms limits liability for gross negligence, willful misconduct or anything else that cannot be limited by law, or any rights you have as a consumer that cannot be waived.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless ProfWorkBench, LLC and its members, personnel and partners from any claim, loss or expense, including reasonable attorneys' fees, arising out of your use of the Services in violation of these Terms or of any law, or your violation of the rights of a third party. This section does not apply to a public body that the law prohibits from giving an indemnity.
15. Export and Sanctions
The Software contains encryption and is subject to United States export control and sanctions laws. You may not use, export or re-export it in violation of those laws, including to any embargoed country or to any person on a U.S. government restricted-party list, and you represent that you are not such a person. The Software is commercial computer software; if you are a U.S. government end user, you receive only the rights granted to all other users under these Terms (FAR 12.212; DFARS 227.7202).
16. Governing Law and Venue
For App Store applications, the governing-law terms of the Standard EULA apply. For everything else, these Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and any dispute will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction, except where the law of your country of residence gives you the right to bring proceedings where you live. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of your country of residence.
17. Changes and General Terms
The version shown at the top of this page is the date the current text took effect. When we change these Terms in a way you need to know about, we publish the new text with a new version date. An application may ask you to agree to the current version. Where the law requires your agreement to a change, the change applies to you once you give it; otherwise it applies to your use of the Services after its version date. Corrections that do not change their meaning keep the version and are noted as an edit. If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Standard EULA where it applies and any program terms you accept, are the entire agreement between you and us about the Services.
